Professor Banks’ scholarship explores membership and belonging in democratic societies. This theme is explored in the areas of immigration, citizenship, law school curriculum, and professional development for faculty. In each of these contexts members are entitled to a set of rights and opportunities that are denied to non-members. Professor Banks’ scholarship examines how membership is defined and operationalized, how those definitions and the application of those definitions align with democratic values, and offers strategies for rethinking membership criteria when it is unjustifiably under-inclusive.
